KUALA LUMPUR, Nov 21 — The exhumation of Teoh Beng Hock’s body for a second autopsy, ordered by the inquest into his recent death, has been completed. The exhumation comes following the testimony of Thai pathologist Dr Pornthip Rojanasunand that the death of the political aide was very likely a homicide.


A team of over ten police forensic experts had earlier cordoned off the grave area with the aid of several cemetery workers, who are helping with the exhumation.

STATUTORY DECLARATION


I, Balasubramaniam a/l Perumal (NRIC NO: xxxxxx-xx-6235) a Malaysian Citizen of full age and residing at [deleted], Selangor, do solemly and sincerely declare as follows :-


1. I have been a police officer with the Royal Malaysian Police Force having joined as a constable in 1981 attached to the Police Field Force. I was then promoted to the rank of lance corporal and finally resigned from the Police Force in 1998 when I was with the Special Branch.


2. I have been working as a freelance Private Investigator since I left the Police Force.


3. Sometime in June or July 2006, I was employed by Abdul Razak Baginda for a period of 10 days to look after him at his office at the Bangunan Getah Asli, Jalan Ampang, between the hours of 8.00 a.m. to 5.00 p.m. each working day as apparently he was experiencing disturbances from a third party.


4. I resigned from this job after 2 ½ days as I was not receiving any proper instructions.


5. I was however re-employed by Abdul Razak Baginda on the 05-10-2006 as he had apparently received a harassing phone call from a Chinese man calling himself ASP Tan who had threatened him to pay his debts. I later found out this gentleman was in fact a private investigator called Ang who was employed by a Mongolian woman called Altantuya Shaariibuu.


6. Abdul Razak Baginda was concerned that a person by the name of Altantuya Shaariibuu, a Mongolian woman, was behind this threat and that she would be arriving in Malaysia very soon to try and contact him.


7. Abdul Razak Baginda informed me that he was concerned by this as he had been advised that Altantuya Shaariibuu had been given some powers by a Mongolian ‘bomoh’ and that he could never look her in the face because of this.


8. When I enquired as to who this Mongolian woman was, Abdul Razak Baginda informed me that she was a friend of his who had been introduced to him by a VIP and who asked him to look after her financially.


9. I advised him to lodge a police report concerning the threatening phone call he had received from the Chinese man known as ASP Tan but he refused to do so as he informed me there were some high profile people involved.


10. Abdul Razak Baginda further told me that Altantuya Shaariibuu was a great liar and good in convincing people. She was supposed to have been very demanding financially and that he had even financed a property for her in Mongolia.


11. Abdul Razak Baginda then let me listen to some voice messages on his handphone asking him to pay what was due otherwise he would be harmed and his daughter harassed.


12. I was therefore supposed to protect his daughter Rowena as well.


13. On the 09.10.2006, I received a phone call from Abdul Razak Baginda at about 9.30 a.m. informing me that Altantuya was in his office and he wanted me there immediately. As I was in the midst of a surveillance, I sent my assistant Suras to Abdul Razak Baginda’s office and I followed a little later. Suras managed to control the situation and had persuaded Altantuya and her two friends to leave the premises. However Altantuya left a note written on some Hotel Malaya note paper, in English, asking Abdul Razak Baginda to call her on her handphone (number given) and wrote down her room number as well.


14. Altantuya had introduced herself to Suras as ‘Aminah’ and had informed Suras she was there to see her boyfriend Abdul Razak Baginda.


15. These 3 Mongolian girls however returned to Abdul Razak Baginda’s office at the Bangunan Getah Asli, Jalan Ampang again, the next day at about 12.00 noon. They did not enter the building but again informed Suras that they wanted to meet Aminah’s boyfriend, Abdul Razak Baginda.


16. On the 11.10.2006, Aminah returned to Abdul Razak Baginda’s office on her own and gave me a note to pass to him, which I did. Abdul Razak Baginda showed me the note, which basically asked him to call her urgently.


17. I suggested to Abdul Razak Baginda that perhaps it may be wise to arrange for Aminah to be arrested if she harassed him further, but he declined as he felt she would have to return to Mongolia as soon as her cash ran out.


18. In the meantime I had arranged for Suras to perform surveillance on Hotel Malaya to monitor the movements of these 3 Mongolian girls, but they recognized him. Apparently they become friends with Suras after that and he ended up spending a few nights in their hotel room.


19. When Abdul Razak Baginda discovered Suras was becoming close to Aminah he asked me to pull him out from Hotel Malaya.


20. On the 14.10.2006, Aminah turned up at Abdul Razak Baginda’s house in Damansara Heights when I was not there. Abdul Razak Baginda called me on my handphone to inform me of this so I rushed back to his house. As I arrived, I noticed Aminah outside the front gates shouting “Razak, bastard, come out from the house”. I tried to calm her down but couldn’t so I called the police who arrived in 2 patrol cars. I explained the situation to the police, who took her away to the Brickfields police station.


21. I followed the patrol cars to Brickfields police station in a taxi. I called Abdul Razak Baginda and his lawyer Dirren to lodge a police report but they refused.


22. When I was at the Brickfields police station, Aminah’s own Private Investigator, one Mr. Ang arrived and we had a discussion. I was told to deliver a demand to Abdul Razak Baginda for USD$500,000.00 and 3 tickets to Mongolia, apparently as commission owed to Aminah from a deal in Paris.


23. As Aminah had calmed down at this stage, a policewoman at the Brickfields police station advised me to leave and settle the matter amicably.


24. I duly informed Abdul Razak Baginda of the demands Aminah had made and told him I was disappointed that no one wanted to back me up in lodging a police report. We had a long discussion about the situation when I expressed a desire to pull out of this assignment.


25. During this discussion and in an attempt to persuade me to continue my employment with him, Abdul Razak Baginda informed me that :-


25.1. He had been introduced to Aminah by Datuk Seri Najib Tun Razak at a diamond exhibition in Singapore.


25.2. Datuk Seri Najib Tun Razak informed Abdul Razak Baginda that he had a sexual relationship with Aminah and that she was susceptible to anal intercourse.


25.3. Datuk Seri Najib Tun Razak wanted Abdul Razak Baginda to look after Aminah as he did not want her to harass him since he was now the Deputy Prime Minister. <!–[endif]–>


25.4. Datuk Seri Najib Tun Razak, Abdul Razak Baginda and Aminah had all been together at a dinner in Paris.


25.5. Aminah wanted money from him as she felt she was entitled to a USD$500,000.00 commission on a submarine deal she assisted with in Paris.


26. On the 19.10.2006, I arrived at Abdul Razak Baginda’s house in Damansara Heights to begin my night duty. I had parked my car outside as usual. I saw a yellow Proton Perdana taxi pass by with 3 ladies inside, one of whom was Aminah. The taxi did a U-turn and stopped in front of the house where these ladies rolled down the window and wished me ‘Happy Deepavali’. The taxi then left. <!–[endif]–>


27. About 20 minutes later the taxi returned with only Aminah in it. She got out of the taxi and walked towards me and started talking to me. I sent an SMS to Abdul Razak Baginda informing him “Aminah was here”. I received an SMS from Razak instructing me to “delay her until my man comes”.


28. Whist I was talking to Aminah, she informed me of the following :-


28.1. That she met Abdul Razak Baginda in Singapore with Datuk Seri Najib Tun Razak.


28.2. That she had also met Abdul Razak Baginda and Datuk Seri Najib Tun Razak at a dinner in Paris.


28.3. That she was promised a sum of USD$500,000.00 as commission for assisting in a Submarine deal in Paris.


28.4. That Abdul Razak Baginda had bought her a house in Mongolia but her brother had refinanced it and she needed money to redeem it.


28.5. That her mother was ill and she needed money to pay for her treatment.


28.6. That Abdul Razak Baginda had married her in Korea as her mother is Korean whilst her father was a Mongolian/Chinese mix.


28.7. That if I wouldn’t allow her to see Abdul Razak Baginda, would I be able to arrange for her to see Datuk Seri Najib Tun Razak.


29. After talking to Aminah for about 15 minutes, a red Proton Aeroback arrived with a woman and two men. I now know the woman to be Lance Corporal Rohaniza and the men, Azilah Hadri and Sirul Azahar. They were all in plain clothes. Azilah walked towards me while the other two stayed in the car.


30. Azilah asked me whether the woman was Aminah and I said ‘Yes’. He then walked off and made a few calls on his handphone. After 10 minutes another vehicle, a blue Proton Saga, driven by a Malay man, passed by slowly. The driver’s window had been wound down and the driver was looking at us.


31. Azilah then informed me they would be taking Aminah away. I informed Aminah they were arresting her. The other two persons then got out of the red Proton and exchanged seats so that Lance Corporal Rohaniza and Aminah were in the back while the two men were in the front. They drove off and that is the last I ever saw of Aminah.


32. Abdul Razak Baginda was not at home when all this occurred.


33. After the 19.10.2006, I continued to work for Abdul Razak Baginda at his house in Damansara Heights from 7.00 p.m. to 8.00 a.m. the next morning, as he had been receiving threatening text messages from a woman called ‘Amy’ who was apparently ‘Aminah’s’ cousin in Mongolia.


34. On the night of the 20.10.2006, both of Aminah’s girlfriends turned up at Abdul Razak Baginda’s house enquiring where Aminah was. I informed them she had been arrested the night before.


35. A couple of nights later, these two Mongolian girls, Mr. Ang and another Mongolian girl called ‘Amy’ turned up at Abdul Razak Baginda’s house looking for Aminah as they appeared to be convinced she was being held in the house.


36. A commotion began so I called the police who arrived shortly thereafter in a patrol car. Another patrol car arrived a short while later in which was the investigating officer from the Dang Wangi Police Station who was in charge of the missing persons report lodged by one of the Mongolians girls, I believe was Amy.


37. I called Abdul Razak Baginda who was at home to inform him of the events taking place at his front gate. He then called DSP Musa Safri and called me back informing me that Musa Safri would be calling my handphone and I was to pass the phone to the Inspector from the Dang Wangi Police Station.


38. I then received a call on my handphone from Musa Safri and duly handed the phone to the Dang Wangi Inspector. The conversation lasted 3 – 4 minutes after which he told the girls to disperse and to go to see him the next day.


39. On or about the 24.10.2006, Abdul Razak Baginda instructed me to accompany him to the Brickfields Police Station as he had been advised to lodge a police report about the harassment he was receiving from these Mongolian girls.


40. Before this, Amy had sent me an SMS informing me she was going to Thailand to lodge a report with the Mongolian consulate there regarding Aminah’s disappearance. Apparently she had sent the same SMS to Abdul Razak Baginda. This is why he told me he had been advised to lodge a police report.


41. Abdul Razak Baginda informed me that DPS Musa Safri had introduced him to one DSP Idris, the head of the Criminal division, Brickfields Police Station, and that Idris had referred him to ASP Tonny.


42. When Abdul Razak Baginda had lodged his police report at Brickfields Police Station, in front of ASP Tonny, he was asked to make a statement but he refused as he said he was leaving for overseas. He did however promise to prepare a statement and hand ASP Tonny a thumb drive. I know that this was not done as ASP Tonny told me.


43. However ASP Tonny asked me the next day to provide my statement instead and so I did.


44. I stopped working for Abdul Razak Baginda on the 26.10.2006 as this was the day he left for Hong Kong on his own.


45. In mid-November 2006, I received a phone call from ASP Tonny from the IPK Jalan Hang Tuah asking me to see him regarding Aminah’s case. When I arrived there I was immediately arrested under S.506 of the Penal Code for Criminal intimidation.


46. I was then placed in the lock up and remanded for 5 days. On the third day I was released on police bail.


47. At the end of November 2006, the D9 department of the IPK sent a detective to my house to escort me to the IPK Jalan Hang Tuah. When I arrived, I was told I was being arrested under S.302 of the Penal Code for murder. I was put in the lock up and remanded for 7 days.


48. I was transported to Bukit Aman where I was interrogated and questioned about an SMS I had received from Abdul Razak Baginda on the 19.10.2006, which read “delay her until my man arrives”. They had apparently retrieved this message from Abdul Razak Baginda’s handphone.


49. They then proceeded to record my statement from 8.30 a.m. to 6.00 p.m. every day for 7 consecutive days. I told them all I knew including everything Abdul Razak Baginda and Aminah had told me about their relationships with Datuk Seri Najib Tun Razak but when I came to sign my statement these details had been left out.


50. I have given evidence in the trial of Azilah, Sirul and Abdul Razak Baginda at the Shah Alam High Court. The prosecutor did not ask me any questions in respect of Aminah’s relationship with Datuk Seri Najib Tun Razak or of the phone call I received from DSP Musa Safri, whom I believe was the ADC for Datuk Seri Najib Razak and/or his wife.


51. On the day Abdul Razak Baginda was arrested, I was with him at his lawyers office at 6.30 a.m. Abdul Razak Baginda informed us that he had sent Datuk Seri Najib Tun Razak an SMS the evening before as he refused to believe he was to be arrested, but had not received a response.


52. Shortly thereafter, at about 7.30 a.m., Abdul Razak Baginda received an SMS from Datuk Seri Najib Tun Razak and showed, this message to both myself and his lawyer. This message read as follows :- “I am seeing IGP at 11.00 a.m. today …… matter will be solved … be cool”.


53. I have been made to understand that Abdul Razak Baginda was arrested the same morning at his office in the Bangunan Getah Asli, Jalan Ampang.


54. The purpose of this Statutory declaration is to :-


54.1. State my disappointment at the standard of investigations conducted by the authorities into the circumstances surrounding the murder of Altantuya Shaariibuu.


54.2. Bring to the notice of the relevant authorities the strong possibility that there are individuals other than the 3 accused who must have played a role in the murder of Altantuya Shaariibuu.


54.3. Persuade the relevant authorities to reopen their investigations into this case immediately so that any fresh evidence may be presented to the Court prior to submissions at the end of the prosecutions case.


54.4. Emphasize the fact that having been a member of the Royal Malaysian Police Force for 17 years I am absolutely certain no police officer would shoot someone in the head and blow up their body without receiving specific instructions from their superiors first.


54.5. Express my concern that should the defence not be called in the said murder trial, the accused, Azilah and Sirul will not have to swear on oath and testify as to the instructions they received and from whom they were given.


55. And I make this solemn declaration conscientiously believing the same be true and by virtue of the provisions of the Statutory Declaration Act 1960.

KUALA LUMPUR, Nov 17 – Malaysia is now seen to be more corrupt than ever, anti-graft watchdog Transparency International said in its global corruption perception index 2009 launched today.


Malaysia now ranks 56 out of 180 countries in the world with a corruption index score of 4.5 out of 10, with 10 being the least corrupt, said the world corruption watchdog. Last year, it placed 47 with a CPI score of 5.1.


The three least corrupt countries in the world are, in order, New Zealand, Denmark and Singapore.


In an immediate reaction, DAP Parliamentary leader Lim Kit Siang called Malaysia’s ranking the worst in 15 years and said it was a major blow to Prime Minister Datuk Seri Najib Tun Razak’s administration.


“This is a national shame and major blow for Najib’s premiership,” the Ipoh Timur MP said in a statement.


He said that he had expected poor results for Malaysia both in CPI ranking and score, with the country slipping further in ranking from 47 to perhaps 50 and score a lowest CPI of 4.8.


“But my worst fears had been exceeded when the Berlin-based TI just announced that Malaysia had plunged nine places from last year’s 47th CPI ranking to 56th position while Malaysia CPI index score plunged to the lowest in 15 years to 4.5,” he added.


Malaysia’s previous worst scores below 5 were 4.8 in 2000 and 4.9 in 2002.


Lim said the mysterious death of DAP political aide Teoh Beng Hock on July 16 at the Malaysian Anti-Corruption Commission (MACC) Selangor head office was among the major factors for Malaysia’s worst-ever TI CPI ranking and score.

KUALA LUMPUR, Oct 22 — Tan Sri Dr Koh Tsu Koon (picture) confirmed in Parliament today that the government had engaged Apco Worldwide, an international public affairs and media relations company, to boost its image overseas.


The Malaysian Insider understands that the contract is worth some RM20 million but Koh, in a written reply to a question from DAP’s Serdang MP Teo Nie Ching, did not divulge the exact amount.


“Apco Worldwide was tasked with promoting and improving Malaysia’s image overseas,” said Koh, who is Minister in the Prime Minister’s Department.


He justified the appointment by asserting that a foreign firm would ensure that the country’s communication practice was in line with international standards.


To justify the hefty fees it is charging, The Malaysian Insider understands that Apco Worldwide staff are now generating press releases and conducting media training for the government.


Because of the value of the contract, Apco Worldwide has set up an office for the first time in Malaysia. Its personnel are mainly from the United States, and the main focus of their job remains to improve Prime Minister Datuk Seri Najib Razak’s image.


It is also understood that the government has hired a separate firm in the United States to act as its lobbyist with the Obama administration.


“Appointing an international communication firm is a common practice by governments of other countries,” Koh said in his written reply to Parliament today.


He also said that inaccurate reports in foreign media had affected the international community’s confidence in the country as a stable investment, trade and tourist destination, resulting in the need to appoint Apco.


“Apart from Apco, the ministry and government agencies also appoint other local and international firms, for short and long term to provide communication services,” he said.


“Because the expenses for this service depend on the implementation of the programmes and communication projects planned from time to time according to needs, the total cost cannot be determined for the time being.”


The Malaysian Insider had reported in July that Apco was also tasked with promoting Najib’s image for his first 100 days in office and later to boost the administration’s standing worldwide.


Najib is not the first prime minister, however, to use expensive foreign help to boost his image and that of his administration.


Tun Abdullah Ahmad Badawi also used a foreign-based public relations firm to help project a positive image of himself as a progressive Muslim leader, and Malaysia as a modern Muslim nation.


The Tun Dr Mahathir Mohamad administration had used disgraced lobbyist Jack Abramoff.

KUALA LUMPUR - MCA deputy president Dr Chua Soi Lek said the thought of going back to the Cabinet has never occurred to him.

'I never think of any government post. I have never asked for any post, not even in the GLCs (Government-Linked Companies), or whatever it is. If anybody thinks I'm fighting because I want to go back to the Cabinet, I think they will fall flat on their face.

'If they think I want to fight because I want to be appointed to any statutory body like KTMB, then they are wrong. You can check with anybody. I never asked for this,' he told Bernama in an interview.

'I'm happy with what I have'

Instead, Chua said, he did not understand why some people wanted to link the greater unity plan (GUP) with a Cabinet position when he already made it clear that he was not asking for any government position.

'Why must GUP be linked to a Cabinet position?' he asked. 'I'm happy with what I have and what I am. If people want to find fault with me all the time, they can carry on. I was quite amazed when one person wanted to be personal with me during the briefing on Sunday. He was chased out,' he said.

During the briefing on GUP at the party headquarters, a grassroots leader from the party's Selayang division raised the issue of Chua's involvement in a sex DVD scandal and was asked to leave the meeting by the other grassroots members.

Chua said that even during his tenure as a member of the Johor Education Foundation, he had discouraged his children from applying for study loans from the foundation.

Instead, they had to further their studies with other scholarships, he added.

chua soi lek 2.jpgOn the meeting between the MCA and top leaders of the Chinese community Monday night, Chua said the community leaders expressed their concern and wanted the party's internal conflict to be resolved as soon as possible.

'They felt that there was nothing that cannot be discussed and settled within a short possible time,' he said.

Back PM's economic initiatives

Apart from that, Chua said, the party also discussed with the community leaders matters related to the economy, and they were generally supportive of the prime minister's economic initiatives.

'They said the prime minister is on the right track, (implementing measures) such as the relaxation of the quota ruling (of 30 per cent Bumiputera equity requirement for 27 services sub-sectors) and (deregulation of the) Foreign Investment Committee (FIC) guidelines but they felt more needed to be done in order to attract direct foreign investment.

'They also agreed that we (Malaysia) are too dependent on foreign workers, which we (the MCA) have raised before,' he said.

Chua also said that during the meeting, the community leaders also wanted the government to give financial aid, in a systematic manner, to Chinese schools and independent schools.

On another matter, Chua said the MCA will likely adopt direct election for all the central committee (CC) positions instead of just the president and deputy president posts.

He said the direct election system, which was discussed during the greater unity plan' (GUP) briefing, would allow the members at the branch and divisional levels to determine the party leadership.

'While the party has deliberated on direct presidential election, it's not just the president but the whole CC should be elected in the manner where more members can participate and decide on the leadership,' he told Bernama Tuesday.

Umno direct election method

He said the party would adopt the Umno direct election method, which has broaden the voting right to some 140,000 party members, not just the party delegates, and is manageable and practical.

'Of course one method is using the party membership list. However, we feel that with one million members, the logistics involved can be huge. One million turnout is equivalent to one tenth of the number of voters in the general election.'

Moreover, Chua said, using the party membership list could create more controversies as the list might be disputed while the logistical requirement would lead to the issue of poor monitoring system.

'So, I'm more in favour for more people involved but it's manageable. One of the mechanisms considerd is the Umno method.

'We feel that it may also work for our party, not the two-tier system as suggested by some party leaders,' he said.

Some party leaders have suggested that MCA adopt the two-tier election system where the posts of president, deputy president, state chairman and deputy state chairman are elected directly from the branch level, while the vice-president and other CC positions by the party delegates.

However, Chua said the party had not come up with the final details on the system except some framework.

'When we had the unity briefing, we discussed it. Tomorrow, I will present it at the CC meeting,' he added.

On fresh party polls, Chua said there was no doubt that there was a need for a new mandate for the party leadership, but the question was the timing.

'Politics is not static'

'The next party election is in 2011, which means we've got one and a half years from now. So, we need to get the system ready and amend the party constitution.

'Politics is not static. If the grassroots say we don't need fresh elections as the party is stable now, then it's well and good. But we must be prepared to face the grassroots, may be six or eight months down the line when the new model of electing the central leadership is put in place.'

Chua said the CC at its meeting tomorrow would also discuss funding for the divisions to carry out their activities after the party lost several state and parliamentary seats in the general election last year.

'We will discuss whether the funding should be based on the number of members in a division and whether the party has a state or parliamentary seat in the divisional area. If there is, then we should give such divisions more funding.

'However, if the MCA elected representative is a minister or state exco member, the party should not fund the division. Instead, they should help fund the divisional activities,' he said. - Bernama

FEATURE LAWYER Sulaiman Abdullah, a native of Penang, recalled that there were, at one time, polls to elect the city mayor other councilors in the state.

It was his early glimpse of what democracy and the Constitution is all about – justice for the people and not to be suppressed by those in power.

“The King is the protector of the land; not the lord of the land like his foreign medieval counterparts, he said at a forum to mark the launch of the Bar Council’s MyConstitution campaign on Nov 13. Deputy Minister in the Prime Minister's Department Liew Vui Keong officiated at the launch.

The two-year campaign sets to get all Malaysians – especially the younger citizens aged 15 to 35 – to understand their rights, as enshrined in the country’s Constitution, and to use this charter as their guide in nation-building.

Sulaiman, the co-chairman of the Pro Bono and Access to Justice Committee of the International Bar Association, was among the law activists and academicians who shared their views on the future direction of the country’s supreme law; the Federal Constitution.

The others were Dr Azmi Sharom, an associate professor at Universiti Malaya’s Law Faculty, Malik Imtiaz Sarwar, president of the National Human Rights Society (Hakam), Dr Abdul Aziz Bari, a political commentator and constitutional lawyer Emeritus Prof Dr Shad Saleem Faruqi.

Chairing the forum was the Bar Council’s past president, Ambiga Sreenevasan, who is also a executive committee member of the feminist Women’s Aid Organisation (WAO).

Guarantees rights of people

constitution-1.jpg“The Constitution is the basic document that guarantees the rights of the people,” said Sulaiman, pledging he would defend it.

His reference to local elections is pertinent and consistent with calls by various quarters to revive such elections, which were suspended after the Indonesia-Malaysia confrontation in 1964.

The suspension was never lifted and the matter instead was made permanent under the Local Government Act 1976, which stipulates that local government members be appointed by the respective state governments.

In the March 2008 general elections, the DAP and the PKR included in their manifesto that local elections would be revived if they were to chosen to lead the country.

The two parties, together with PAS, managed to topple the Barisan Nasional in several states but they are still not able to carry out the plan to hold local council elections due to the Federal Constitution which prohibited the implementation.

Political observers feel it is unlikely that such elections would be brought back because 'policymakers know from experience worldwide that the Opposition tends to dominate such councils as part of the electorate's desire for checks-and-balances.'

The ruling Barisan Nasional coalition, however, has its own reason for not wanting to hold more elections: “It is expensive.”

The electoral process and the right to vote are among the more familiar provisions of the Constitution, which is divided into 15 parts and 13 Schedules.
Each part and schedule contains relevant articles. There are 230 articles in the 15 parts, including those which have been repealed.

It provides for the establishment and the organisation of three main branches of the government - Parliament, which consists of the House of Representatives (Dewan Rakyat) and the Senate (Dewan Negara); the executive branch represented by the prime minister and his Cabinet ; and the judicial branch headed by the Federal Court.

Provides answers to pertinent issues

liew-vui-keong.jpgLiew said the role of the citizen is the most important one to be established by the Constitution 'because without the active knowledge and participation of citizens, our Constitution is an empty.meaningless and lifeless document.'

He added: 'The nobility of a good consitution is incumbent on its citizens and how they accept and practise law and order.

'The opposite of this is, of course, lawlessness and wanton behaviours.

'The country would be crippled with setbacks and unable to progress further than 'page one'.'

The Constitution, said to be the lifeline of the nation, also defines the rights and responsibilities of the Federal government, each member state and the citizens.

Thus, the Constitution is rightly the custodian of the people’s rights and provides the answers to all pertinent issues.

my-constitution-logo.jpgTo make it easier to understand and to make it within reach of every household, the Bar Council has printed a simplified guide on the Constitution in the form of a leaflet, which will be distributed throughout the country.

The council hopes to capture a following of at least six million people over the next two years through the campaign.

The Bar Council feels that some of the country’s laws are ‘archaic’ and has formed a reforms committee to look into possible changes to meet current developments; but without undermining the spirit of the Constitution.

For instance, the committee would look into the provisions of the 40-year-old Internal Securities Act and recommend to the Home Ministry some changes to suit the day’s climate.

The Bar Council pertinently pointed out that it is for such reason that every Malaysian should know their Constitution and to not just be influenced by the media and politicians, who are also not very well-versed in the charter.

What is the Constitution?

Dr Aziz said the Constitution is simply ‘the basic law of the land’ and any other law or regulation must go back to it.

Welcoming the move to make the Constitution people-friendly through the Bar Council’s campaign, he said all this while it had been perceived that only the politicians and lawmakers ‘own’ the charter.

Dr Aziz said: “The Constitution is intended as a social contract and documented by Malaysia’s forefathers to facilitate the democracy of the emerging nation (then knoqwn as Malaya, which gained independence in 1957).

“They (the country’s founding fathers) acknowledged that the Malays and other natives are the sons of the soil but did not sideline others who make up the nation, “ he said, adding that there are politicians who are fond of using the ‘bumiputra’ issue to incite tensions and hatred among the races.

“The politicians forget that there are many more clauses in the Constitution to promote unity among the people.

“That is why educating the public is important, as also making the legalistic side of the Constitution more transparent,” said Dr Aziz.

Dr Shad Saleem agreed that the Constitution is the basic law of the land but, he added, everyone should have the right to go to the court. “Thus, no law or any person must - or can - be above the Constitution.

He suggested that the government be challenged if it acts wrongly; reiterating that the Constitution is the basis for every other law;be it legal, political or social.constitution-2.jpg

“It is the basic infrastructure of nation building and should stay in the middle of the majority and the minority, like it was intended to.

“The people must together seek to reconcile with and uphold the Constitution, since it is the shield that protects the whole nation and not to allow it to collapse.

Standing tall and still progressing

“When other multi-ethnic countries have turned to ashes, Malaysia with is multi-faceted population is still standing tall and progressing,”
he said.

Dr Shad Saleem akins Malaysians to the colours of the rainbow – separated but not apart.

“But there is still a lot of hard work to be done to ensure that the beautiful rainbow that is called Malaysia will live forever,” he added.

To achieve this, he said, Constitutional literacy must be encouraged.

“The Constitution must be higher than the executive and administrative laws,” he said, urging all Malaysians to respect the social contract that had been agreed to and to compromise where it helps and where it hurts.
